between Wild Hearts Adventure Co., referenced throughout as the “Company” or the “Employer” a limited liability company incorporated under the laws of California, and having its principal place of business at 3710 W LaVida Ave, Visalia Ca 93277, and

Whereas the Employer desires to obtain the benefit of the services of the Employee, and the Employee desires to render such services on the terms and conditions set forth.  

In consideration of the promises and other good and valuable consideration, the parties agree as follows:

Employment Agreement

The Employee agrees that they will at all times faithfully, industriously, and to the best of their skills, experience, and talents, perform all of the duties required of the position. In carrying out these duties and responsibilities, the Employee shall comply with all relevant Employer policies, procedures, rules, and regulations, both written and oral, as announced by the Employer from time to time.

Employment under this agreement shall begin as of the above-listed date and shall be for an unspecified term on an “at will” basis, meaning both parties reserve the right to terminate employment at any time and without any advance notice and for no particular reason or cause.

The Contractor agrees to complete all background checks, fingerprinting, and other screening requirements required by the Company or by applicable federal, state, local, charter, or licensing requirements as a condition of providing services.

The Employee agrees to complete all required trainings, certifications, acknowledgments, and policy reviews assigned by the Company.

The Company will reimburse the Employee for all required background check, fingerprinting, and training expenses, as well as compensate the Employee for time spent completing required trainings. Reimbursement requests and time worked must be submitted in accordance with the Company's reimbursement and invoicing procedures.

The Employee acknowledges and agrees that they will retain their status as an independent contractor. As such, the Employee is responsible for submitting an invoice to the Company on or after their last working day of each month.

The Company will issue payment within 10 calendar days of receiving the invoice.

Invoices must be submitted no later than 60 calendar days after the last working day of the month in which the services were rendered.

Requests for reimbursement of pre-approved supplies or materials purchased for classes, projects, or other authorized Company activities may be submitted at any time using the Company's designated online reimbursement form.

To help ensure prompt payment, we suggest notifying the Director by text message or email after submitting a request.

Hours and Compensation

This position is expected to average one of the following schedules, based on the needs of the company:

  • Full Day: Approximately 6.5 hours per day, from 9:00 a.m. to 3:30 p.m., at a rate of $125 per day.
  • Half Day: Approximately 3.25 hours per day, from 9:00 a.m. to 12:15 p.m. or 12:15 p.m. to 3:30 p.m., at a rate of $65 per day.

The Employee's schedule will be determined based on the company's operational needs and will be reviewed approximately every 6–8 weeks.

Additional hours outside of the Employee's regularly scheduled workday may be approved by the Employer and will be compensated at a rate of $20.00 per hour. Prior approval from the Employer is required before working any additional hours.

Examples of additional approved hours may include, but are not limited to:

  • Staff meetings held outside of working hours.
  • Required attendance at special events held outside of working hours.

Position and Job Description

As a Studio Guide, the Employee is required to perform all of their necessary job functions and duties as defined in the contract.

  • Employee is responsible to plan, supervise and direct learning activities in accordance with the parameters set forth by the employer.
  • Employee is responsible to maintain a safe and reasonably organized environment for students at  all times.

Employee must possess and be willing to work toward development of the following characteristics:

  • An entrepreneurial mindset and desire to work hard, solve problems, and improve on everything they do
  • A deep love and respect for all children and empathy for the challenges children face in their lives
  • A strong teamwork ethic, a genuine desire to collaborate with colleagues, and a commitment to professionalism

  • Vulnerability and courage to try new things, make mistakes, and the ability to reflect

Social Media Agreement

Employee agrees to maintain the appearance of propriety in all public scenarios including social media. Respect and inclusivity are core values of our community and as such all employees are expected to refrain from any public social media posts or comments on topics that may be considered unethical, lewd, controversial, or divisive in nature. (ie. any political, religious, or other contraversial topics, including personal choices involving alcohol, nicotine, drug use, etc.) This would also include private groups that are open to the public for membership. Our goal is for learners to view all guides as neutral, safe, and supportive of all individual and family beliefs and choices.

Intellectual Property Agreement

It is agreed that the Company will retain full ownership of any and all intellectual property created in the course of employment.

Non-Solicitation Agreement

The Employee further agrees not to solicit any Company employee to leave his/her employ with the Company, either directly or indirectly, or solicit the business of any Company client or customer, partner, agent or consultant.

This agreement constitutes an entire agreement between both parties, and there are no further items or provisions, either written or oral.  The parties to this agreement stipulate that neither of them has made any representations with respect to the subject matter of this agreement except such representations as are specifically set forth in this agreement.

Mandated Reporter Compliance

The Employee acknowledges their responsibilities as a California Mandated Reporter and agrees to comply with all applicable mandated reporting laws and requirements while providing services for Wild Hearts Education Community, LLC.
